Service Description
Foamo is an iOS app that grades your latte art using artificial intelligence. You photograph your pour, select your milk type, and receive a detailed score with feedback to help you improve.
Subscription Terms
Foamo offers optional auto-renewing subscriptions for unlimited AI grading:
- Monthly — $4.99/month
- Annual — $29.99/year
Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
Payment is charged to your iTunes Account. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription. Subscriptions are subject to Apple's terms, and refund requests must be directed to Apple.
Cancellation
You can cancel your subscription at any time through your iPhone's Settings:
- Open Settings on your iPhone
- Tap your name at the top, then Subscriptions
- Select Foamo and tap Cancel Subscription
After cancellation, you'll continue to have access until the end of your current billing period. No refunds are provided for partial billing periods.
Free Credits
New users receive 5 free grading credits upon creating an account. Free credits do not expire but are non-transferable and have no monetary value. Once your free credits are used, a subscription is required for continued grading.
Acceptable Use
You agree to use Foamo only for its intended purpose — grading latte art. You may not:
- Attempt to reverse-engineer, decompile, or extract the AI grading system
- Use the service to process images unrelated to latte art
- Create multiple accounts to abuse free credits
- Interfere with or disrupt the service's infrastructure
Age Requirements
You must be at least 13 years old to use Foamo (or the minimum age required by the laws of your jurisdiction, if higher). If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these terms.
Your Content
You retain ownership of all photos you take with Foamo. By using the service, you grant us a limited license to process your images for AI grading and to store them on your behalf. We do not use your photos for training AI models or share them with third parties beyond what's necessary for grading (see our Privacy Policy).
Indemnification
You agree to indemnify, defend, and hold harmless Cold Start Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these terms or your misuse of the service.
Third-Party Services
Foamo relies on the following third-party services to operate:
- Apple — Authentication (Sign in with Apple) and payment processing
- Google Gemini — AI-powered image analysis for grading
- Supabase — Data storage and cloud infrastructure
- RevenueCat — Subscription management
Your use of these services is subject to their respective terms.
Account Deletion
You can permanently delete your account and all associated data from the Settings screen within the app. Deletion removes your profile, all pours, photos, and progress. This action cannot be undone. If you have an active subscription, remember to cancel it separately through your iPhone's Settings before deleting your account.
Disclaimer & Limitation of Liability
Foamo's AI grading is informational and educational only. Scores and feedback are generated by artificial intelligence and should be treated as subjective guidance, not authoritative assessments. We make no guarantees about the accuracy or consistency of grades.
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Cold Start Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Foamo. Our total aggregate liability for all claims shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Governing Law & Dispute Resolution
These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
Any dispute arising from these terms or your use of Foamo shall first be resolved through informal negotiation. If not resolved within 30 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in New York, NY. Any dispute resolution will be conducted on an individual basis, not as a class or representative action.
If you are a consumer in the European Union, nothing in these terms affects your rights under mandatory consumer protection laws in your country of residence.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Cold Start Labs LLC regarding your use of Foamo. These terms are also subject to Apple's Licensed Application End User License Agreement, available at apple.com/legal/....

Changes to These Terms
We may update these terms from time to time. For material changes, we will notify you by posting a notice within the app. The "Last Updated" date above will reflect the most recent revision. Continued use of Foamo after changes constitutes acceptance of the revised terms.
